Welcome to Kathmandu Travel Pty Ltd (ABN: pending). These Terms govern your use of our website and services, including bookings for Nepal tours, cruises, flights, and adventures. If you do not agree, please do not use the site or our services.

We are a Sydney-based agency and comply with Australian Consumer Law under the Competition and Consumer Act 2010 (Cth). See our Privacy Policy and Cookie Policy for how we handle data.

1 Booking and Reservations

  • Eligibility: 18+ or booking with appropriate consent; subject to availability and approval.
  • How to Book: Email, phone (+61 2 926 75 629), WhatsApp/Viber (+61 402 950 739), or in-person at Suite 607, Level 6, 321 Pitt St, Sydney.
  • Deposit & Payments: Typically 20–50% deposit; full payment due before departure (e.g., 60 days). Cards and bank transfers accepted.
  • Pricing: AUD, GST-inclusive where applicable. Prices may change due to currency, fuel, or supplier updates. We'll notify before final payment.
  • Itinerary Changes: We may adjust for safety/operations. Significant changes offer refund or alternative.

2 Cancellations and Refunds

By You

  • >60 days: Full refund minus admin fee (AUD 100–200).
  • 30–60 days: 50% refund.
  • <30 days: No refund.
  • Flights/cruises follow supplier rules, often non-refundable.

By Us

We may cancel for low numbers, unforeseen events, or non-payment. You'll receive a full refund or credit. We're not liable for ancillary costs.

Refunds are processed within 14–30 days via original method. We strongly recommend comprehensive travel insurance.

3 Travel Documents and Responsibilities

  • Your Responsibilities: Ensure valid passports, visas, vaccinations; we provide guidance but are not liable for entry denials.
  • Health & Fitness: Disclose conditions or special needs. Some adventures require fitness; failure may lead to exclusion without refund.
  • Behavior: Obey local laws and guide instructions. Disruptive behavior may result in removal at your expense.
  • Luggage: We are not responsible for loss/damage/theft. Airline/hotel rules apply.

4 Liability and Disclaimers

  • Our Liability: Limited to the cost of your booking where permitted by law. We act as agent for suppliers and are not liable for their acts/omissions.
  • Risks of Travel: Weather, political situations, and health risks exist. Travel at your own risk; obtain comprehensive insurance.
  • Force Majeure: No liability for events beyond control (natural disasters, strikes, pandemics, wars, restrictions).
  • Website Use: Information is general and may contain errors. No warranties for accuracy.

5 Intellectual Property

All website content, logos, itineraries, and materials are our property or licensed to us. You may not reproduce or reuse materials without written permission.

6 Governing Law

These Terms are governed by the laws of New South Wales, Australia. Disputes will be resolved in Sydney courts. For consumer disputes, you may access free mediation via AFCA or similar bodies.

7 Changes to These Terms

We may update these Terms periodically. Changes will be posted here with an updated date. Continued use constitutes acceptance of the new Terms.

8 Severability

If any provision is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
